171. 33:44In in some cases, they actually bought the media properties and trained on them. And I to be quite fair frank, they
172. 33:51probably did that after the fact, after they knew they were going to get caught. When you embed data, whether it's um
173. 34:01using diffusion models for images or music, whether you're embedding text documents in in LLMs, the original work ceases to exist.
174. 34:13And the way that that that things are generated with AI is some weird amalgamation of what are called tokens
175. 34:21which are fragments that are not recognizable as the original work. It is it is what's what's called in legal
176. 34:29terms transformative that the act of embedding it so transforms the work that it's on the other side it's not the same
177. 34:37thing. What these things are not doing is sampling music. It's not like sampling guitars and when it's going to play back
178. 34:46a song, it's going to play some sample it recorded. That was the 90s. That was the 80s and 90s. We went through court battles on that.
179. 34:54What's happening right now in the court battles is they're basically saying this, the active embedding works using
180. 35:01the transformer architecture is transformative. Therefore, if you paid for it, it's fair use. Now, if you stole it, it's not fair use,

182. 35:21and they bought machines to scan them. And then they also downloaded a whole, you know, database full of stolen books
183. 35:28and they kept that on file. And because of that, they had to pay the $ 1.5 trillion. But for the books that they
184. 35:35bought, it was considered fair use. And the same thing just happened in the midjourney case with Getty Images. It

207. 39:59song, stemmed it, remixed it, did a bunch of [ __ ] like that. But the core song is AI generated. But it but there's
208. 40:06a lot of work that goes into it. So to say that they're not going to have another hit presumes that they don't
209. 40:11know what the [ __ ] they're doing. Like what you're not taking into the mix here is humans using AI tools are are just using
210. 40:23the AI tool as another component in the production mix. It's no different than sampling. Well, it is. It's a lot different because it's
211. 40:34actually generating original works. We're not sampling someone else's work. It's generating an original work. But
212. 40:40how you get to that and how do you how you get something that is worth sharing with the world takes work. It really
213. 40:46does. And so there's people that are going to get really good at that. And then there's gonna there's still
214. 40:52going to be people doing traditional music. That doesn't go away. Um, no performance meeting them. Can I get
215. 41:02their autograph? Um, no. But like the uh the Korean band that that they spent $50 million on, they effectively have a cover band that tours.
216. 41:18So, so they have AI write the songs. They have AI characters, AI musicians, AI performances, AI dances.
217. 41:28They put those out to the world and then they tour with musicians who play the parts. So, yes, you will be like you you will
218. 41:38be able to get their autographs. It's not it's not either or. All I'm saying is it's just this is just another tool in the mix.

229. 43:19generating those images, curating those images, photoshopping those images, doing all that. It was not 100% AI generated.

231. 43:36illustrator, an animator. That's what AI did. But the concept, the storyboards, doing 70,000 images to end up with
232. 43:46probably the 400 that were in that final video. Rick Rubin doesn't get credit. Well, Rick Rick Rubin does get credit. Rick
233. 43:55Rubin gets credit as a producer, but the musicians get the credit, you know, if they wrote it and performed it. [Music]

255. 47:33Right? So, so they made the calculated decision to not go ask for permission. Right? It's San Francisco. They're like,
256. 47:43"Hey, we've got this secret. If we get enough data in here quickly enough, then they can come after us afterwards." But
257. 47:49once it's in there, then the models are going to be built. And that's where we are. Like, we're at a place now where
258. 47:55all of the open- source models are almost as good as all of the commercial models. And so, nobody's bitching about
259. 48:01the the open- source things because I don't know where they got their data, but they probably scraped it off OpenAI
260. 48:08servers. Who [ __ ] knows how they got it? But now that the models have been built, you could choose not to use them out of
261. 48:17principle or you could choose to just say, "I'm just going to use Adobe because, you know, they claim they
262. 48:22didn't train anything on commercial works without permission." I I don't know that that's the case, but that's at least their marketing
263. 48:30positioning. Um, you could do that. Some people do that. Or you could just choose not to use it. You could just say, "AI
264. 48:37is evil. They stole from artists. [ __ ] them people. My problem with that position is the only person that hurts is that person
265. 48:48that's like [ __ ] you to AI cuz they're going to get blasted in the face with the double barrel of what's coming. You know,
266. 48:57so this channel is about saying, okay, let's look at the reality of it. Let's understand how these models actually
267. 49:02work so that if we have a conversation about copyright and is it stealing and is it plagiarism, we can actually talk
268. 49:09intelligently about how it works. We can still have the ethical conversations and then we can say and
269. 49:17because it's not going away and because it's in our hands right now, we might as well learn what it makes possible. And
270. 49:23then we can start to do things like think critically about there are going to be two kinds of AI users in the future. Lazy ones and
271. 49:34creative ones. Lazy ones are going to are are who you're saying you hate, which I agree with. Push a button, squirt out music.
272. 49:45But creative users of AI are just going to use it as a tool in a chain of lots of other ideas and lots of other steps
273. 49:54and lots of other refinements and curations and things like that. And they're going to be working toward an
274. 50:00idea and then when the thing that they create matches that idea and they put that in the world, that's [ __ ] art. I
275. 50:07don't care what tool they used. The person that just pushed a button and squirted out [ __ ] that's not art.
276. 50:13That's a snapshot. In photography, you call, you know, people that just shoot pictures and share them with their
277. 50:19friends or, you know, now they're now we're on a phone, so you're tapping your phone rather than pushing a shutter button.
