So, this 33:26 is one of the things that that is is 33:29 really confusing about AI and and a lot 33:32 of the people that are 33:34 saying that that AI steals from artists. 33:40 The people that did the training of the 33:41 models potentially stole from artists. 33:45 In in some cases, they actually bought 33:47 the media properties and trained on 33:48 them. And I to be quite fair frank, they 33:52 probably did that after the fact, after 33:54 they knew they were going to get caught. 33:57 When you embed data, whether it's um 34:02 using diffusion models for images or 34:04 music, whether you're embedding text 34:05 documents in in LLMs, 34:09 the original work ceases to exist. 34:13 And the way that that that things are 34:16 generated with AI is some weird 34:19 amalgamation of what are called tokens 34:21 which are fragments that are not 34:23 recognizable as the original work. It is 34:26 it is what's what's called in legal 34:30 terms transformative that the act of 34:33 embedding it so transforms the work that 34:36 it's on the other side it's not the same 34:38 thing. What these things are not doing 34:40 is sampling music. It's not like 34:43 sampling 34:44 guitars and when it's going to play back 34:46 a song, it's going to play some sample 34:49 it recorded. That was the 90s. That was 34:51 the 80s and 90s. 34:53 We went through court battles on that. 34:55 What's happening right now in the court 34:57 battles is they're basically saying 34:58 this, the active embedding works using 35:02 the transformer architecture is 35:03 transformative. If if I had, you know, if I 47:02 had whatever they had, you know, when 47:04 they started, half a million dollars 47:07 and and I had this secret and the secret 47:10 was the more data I throw at this thing 47:12 and the more compute I threw at this 47:14 thing, the better it gets, 47:16 they made a calculated risk decision, 47:19 which was this. 47:21 We can go ask every rights holder in the 47:24 world of anything that's ever been 47:27 written for their permission 47:31 or not. 47:34 Right? So, so they made the calculated 47:37 decision 47:38 to not go ask for permission. 47:41 Right? It's San Francisco. They're like, 47:43 "Hey, we've got this secret. If we get 47:45 enough data in here quickly enough, then 47:48 they can come after us afterwards." But 47:50 once it's in there, then the models are 47:52 going to be built. And that's where we 47:53 are. Like, we're at a place now where 47:56 all of the open- source models are 47:58 almost as good as all of the commercial 47:59 models. And so, nobody's bitching about 48:02 the the open- source things because I 48:04 don't know where they got their data, 48:05 but they probably scraped it off OpenAI 48:08 servers. Who [ __ ] knows how they got 48:10 it? But now that the models have been 48:12 built, 48:15 you could choose not to use them out of 48:17 principle or you could choose to just 48:19 say, "I'm just going to use Adobe 48:21 because, you know, they claim they 48:22 didn't train anything on commercial 48:25 works without permission." 48:28 I I don't know that that's the case, but 48:29 that's at least their marketing 48:31 positioning. Um, you could do that. Some 48:33 people do that. Or you could just choose 48:35 not to use it. You could just say, "AI 48:37 is evil. They stole from artists.
